(DNR) - A New Mexico man, dosed with the wrong medication in 2002 during a hospital stay for routine surgery is suing the drug manufacturer for the profits realized from the sale of the drug he was given in the new markets that have been opened up because of the doing mistake and resulting effects. New markets have been opened up now that FDA approval has been received for Valenexium, a blood pressure drug that also has curative value for adult acne. Mr. Sanchez's lawyer stated that "the company would never have realized the millions in future profits had not Mr. Sanchez been given the wrong medication during his stay". Merck Pharmaceutical officials have declined comment citing a company policy of not discussing pending litigation. Also named in the lawsuit are the hospital, the nursing staff and the dispensing physician.
